Hawaii Revised Statutes section 431:20-120, addresses insurance rate requirements. Generally, schedule must be adopted, printed and made public, with any changes requiring public display of 5 days before it becomes effective.

Section 431:20-121 addresses form requirements. Every title insurer, at least thirty days before use, is to file with the commissioner for approval every form of insurance contract which it proposes to issue as to risks located in Hawaii. If the commissioner does not disapprove any such form after expiration of the initial thirty-day advance filing period, it can do so only after a hearing thereon held in accordance with chapter 91.

Louisiana Title Insurance Statistical Services Organization, a private rating organization was authorized in 2006 to make rate filings for its members. R. S. 22:1409(G)(1)(e); and 1409.1.

Act 459 of the 2007 Regular Session of the Louisiana Legislature, effective January 1, 2008, abolished the Louisiana Insurance Rating Commission and generally transferred its functions, including the setting of rates, to the Commissioner of Insurance. At the time of this writing, it is not possible to delineate when new regulations and procedures will be adopted by the Commissioner.

Change to existing forms, addition of forms, and/or deletion of forms are handled through LATISSO in a manner similar to the filing and approval process for rates. The “filing” is made by LATISSO on behalf of all of its members with the Department of Insurance. Once approval of a filing made by LATISSO is granted, any LATISSO member wanting to deviate from that approved filing must file a deviation with the Department of Insurance.

a. Every title insurance company shall file with the commissioner its schedule of fees, every manual of classifications, rules and plans pertaining thereto, and every modification of any of the foregoing which it proposes to use in this State. Every such filing shall state the proposed effective date thereof, and shall indicate the character and extent of the coverage contemplated.

b. A title insurance company may satisfy its obligations to make such filings by becoming a member of, or a subscriber to, a licensed title insurance rating organization which makes such filings, and by authorizing the commissioner to accept such filings on its behalf.

c. The commissioner shall make such review of the filing as may be necessary to carry out the provisions of this act.

d. Beginning 90 days after the effective date of this act, no title insurance company or agent of a title insurance company shall charge any fee for any policy or contract of title insurance except in accordance with filings or rates which are in effect for said title insurance company as provided in this act.

e. The commissioner shall not require the filing of rates or fees for reinsurance contracts or agreements, or policies of excess coinsurance.

NMAC et seq. No rating bureau. Rates are established by Superintendent of Insurance by order subsequent to biennial title insurance hearing. Utah requires forms and rates to be filed. The Utah Insurance Department requires that all form and rate filings be electronically filed and processed through SERFF or SIRCON. See Utah Insurance Department bulletin 2007-03. All filings must include the following language:

Form and rate filings are filed with the Wyoming Insurance Department and must contain the company’s name, address, NAIC number and company phone number. All documents need to be submitted in duplicate and contain a self-addressed, postage paid envelope to return the approved filing. The filing needs to contain a subject line briefly describing the filing type and contain an itemized listing of each policy from and endorsement including the form number. A certificate of compliances needs to be signed by an officer of the company, attorney or actuary. Filings through SERFF are accepted but not required.
