UT Plant Information Guarantee Guideline 17
Assurance is given that according to the company's property records (but without reference to those records indexed by name) there are no specified instruments affecting the land subsequent to a stated date (to be filled in) other than those listed as exceptions. The Guarantee may be made broad enough to include all instruments affecting the land or it may be tailored to include only particular kinds of documents.
The following matters are specifically excluded from coverage:
(1) Unpatented mining claims, reservations or exceptions
in patents or in acts authorizing the issuance thereof;
(2) Water rights, claims or title to water;
(3) Tax Deeds to the State of California;
(4) Instruments, proceedings or other matters which do not specifically describe the land.
Do not use this
Guarantee on the Lot Book Guarantee for environmental due diligence searches on
commercial land. You should use only the Recorded
Document Guarantee in that circumstance.
The Guarantee Face Page (revised 6-6-92) and Guarantee Conditions and Stipulations (revised 6-6-92) must be used with the Plant Information Guarantee Schedule A.
