The policy is hereby amended by replacing Condition 17 b) (for an Owner’s Policy) / Condition 16 b) (for a Loan Policy) with the following:       

b)   Choice of Forum:  Any litigation or other proceeding (except arbitration) brought by the Insured against the Company shall be filed in a court of the State of XXX.  The Insured is permitted only to have the case heard by a judge and not by a jury.

All other terms under Condition 17 (Owner’s Policy) / Condition 16 (Loan Policy) remain unchanged.  By its acceptance of this policy, the Insured agrees to all of the Conditions, and covenants with the Company not to take any action inconsistent with condition b) above.

This endorsement is issued as part of the policy. Except as it expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy, or (iv) increase the Amount of Insurance. To the extent a provision of the policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls. Otherwise, this endorsement is subject to all of the terms and provisions of the policy and of any prior endorsements.

This endorsement is only valid when it bears an authorized Stewart agent countersignature.
