AFFIRMATIVE COVERAGE ENDORSEMENT
The mortgagee title insurance policy referred to herein contains the following affirmative coverages:
(1) Agreements, covenants, conditions and restrictions, if any, appearing of record and/or as set forth in Schedule B of this policy:
This policy insures against any loss or damage by reason of any present violation thereof and insures that any future violation thereof will not result in a forfeiture or reversion of title and that the instruments referred to do not create or provide for a lien prior to the lien of the insured mortgage and that there are no provisions under which the lien of the mortgage can be cut off, subordinated or impaired.
(2) Easements, rights-of-ways or servitudes, if any, appearing on Schedule B or on any filed map:
This policy insures that their locations are ascertainable and fixed, that there are no encroachments of buildings or other improvements into the easement area and that the use of the easements for the purposes intended will not interfere with or damage the improvements presently located on the insured premises.
(3) Taxes and assessments:
The Company affirmatively insures that all real estate taxes and other municipal charges and/or assessments, if any, are liens not yet due and payable.
The Company insures against all loss or damage by reason of any violation, variation, encroachment or adverse circumstance which would have been disclosed by an accurate survey of the insured premises.
This Endorsement is made a part of said policy and is subject to the schedules, conditions and stipulations therein, except as modified by the provisions hereof.
Nothing herein contained shall be construed as extending or changing the effective date of said policy, unless otherwise expressly stated.
Signed under seal for the Company, but this Endorsement is to be valid only when it bears an authorized countersignature.
