RE: LEGISLATIVE UPDATE - Wyoming Legislative Update 2025

Dear Associates:

The following are summaries of bills passed during the 2025 Wyoming Legislative session which may be of interest to the title insurance industry.

House Bill 0219 – County and Municipal Roads Across State Land: This bill grants an easement for the benefit of any County or Municipal Road which crosses state or school Lands as of January 1, 2025. The bill directs Board of Land Commissioners to promulgate rules related to the granting of such easements and requires that all such easements be properly established and documented on or before April 1, 2030. This bill became effective as of March 12, 2025.

Senate File 0006 – Residential Property – Removal of unlawful occupant: This bill creates an expedited process by which the owner of a residential dwelling, or their agent, may request that law enforcement immediately remove any unauthorized occupant from the residential dwelling. The bill requires the owner or their agent to submit a complaint containing certain information to law enforcement to request the removal and provides for a cause of action by the occupant in the event of an unlawful removal. This bill is effective as of July 1, 2025.

Senate File 0104 – Probate Code Revisions: Wyoming law currently provides for certain summary procedures whereby the real and personal property of a decedent may be collected and distributed via an affidavit and publication process rather than via a full probate action. This bill increases the value of estates subject to these summary procedures from no more than $200,000 to no more than $400,000. This bill is effective as of July 1, 2025.
