RE: LEGISLATIVE UPDATE - Colorado Legislative Update

Dear Associates:

The following are summaries of some bills passed during the 2025 Colorado legislative session which are of interest to the title insurance industry.

House Bill 25-1043 – Owner Equity Protection in HOA Foreclosures: This bill is designed to provide additional protections for property owners when a Homeowner’s Association is seeking to foreclose a delinquent assessment lien. Homeowner’s Associations are now required to send notices to the property owner which warn that the owner may lose some of or all their equity in the event of a foreclosure. The bill also creates a legal process by which an owner may delay the foreclosure sale by up to nine (9) months to allow them time to sell the property at fair market value. This bill is effective as of October 1, 2025.

House Bill 25-1219 – Requirements for Understanding Metro Districts: This bill creates additional requirements aimed at assisting the public in understanding Metropolitan Districts. Among other changes, Metro Districts are now required to send notices of annual meetings to residents via mail or email. In addition, Metro Districts are now required to post certain information on their publicly available websites and must provide a method for submitting questions via the website. This bill is effective as of August 6, 2025.

Senate Bill 25-016 – Updating Escrow Disbursement Practices: This bill provides updates to Colorado’s “Good Funds” statute. The revised definition of Good Funds now includes wire transfers, real-time or instant payments made through transfer services operated by the Federal Reserve or the Clearing House Payments Company. This bill is effective as of August 6, 2025.

Senate Bill 25-277 – Sunset Title Insurance Commission: This bill sunsets Colorado’s Title Insurance Commission and replaces it with a Title Advisory Group (TAG). The bill requires the Insurance Commissioner or their designee to meet with the TAG at least twice per year and to respond in writing to TAG proposals or recommendations. This bill is effective as of August 6, 2025.

House Bill 24-1269 – Modification of Recording Fees: As a reminder, House Bill 24-1269 became effective as of July 1, 2025. This bill eliminates Colorado’s per page recording fee and replaces it with a flat recording fee of $40.00 per document. The bill also eliminates the recording fee for death certificates and mandates the redaction of any Social Security Number shown in a document.
