Recitals

An instrument such as a deed or mortgage in the chain of title may disclose an unrecorded lease, contract, mortgage, easement or other interest in the title. By such disclosure, the interest is then considered part of the chain of title and is binding on subsequent purchasers. Consequently, exception should be made to such recited interests. If recitals related to the condition of the land, you should call the Company.

Require Release of Unrecorded Matters

Said mortgage should be produced, examined, recorded and satisfied of record or the recital in said instrument must be satisfactorily explained to the Company.

RECR03 STG

Recital of Agreement not of record

Deed made by __(name)__ to __(name)__, dated __/__/__, recorded __/__/__ in (Liber, Record Liber, Reel) _____, (C)p ______, recites an agreement __(give facts)__, which cannot be found of record. This agreement must be produced, examined, recorded and its effect on title determined. Title is subject to such objection which an examination of said agreement may disclose.
