LA ALTA Endorsement Form 8.1 (Environmental Protection Lien)
Explanation:The environmental protection lien endorsement is issued in conjunction only with a mortgagee's policy and only on one-to-four family residential property. It provides assurances that there are no environmental protection liens filed in the local records or in the federal district court clerk's office that could have priority over the lien of the insured mortgage (unless any such lien is excepted); it also provides assurance that there are no state statutes that could create liens later filed which would have priority over the lien of the insured mortgage except those statutes specifically excepted.
The underwriting requirements are as follows:
- This endorsement may be issued only on property that is improved, zoned, restricted, or under construction, for residential purposes.
- You are required only to review your local records for liens filed. You are not required to check the federal district court clerk's office.
- Because some states have not enacted the Uniform Federal Lien Registration Act or similar legislation, Stewart Title Guaranty Company may periodically mail to you liens filed by the EPA. You should consider these liens in the examination of the title.
- Our endorsement contains excluded matters agreed to by Fannie Mae. Therefore, it is not necessary to except to various state statutes. Our forms either state "No Exception" or contain one of the following additional exceptions:
Louisiana - La. Rev. Stat. Ann. §13:2575 (applicable only to municipalities of 475,000 or more) and §30:2281;
