The Use Agreement for Multifamily Projects Participating in the Mark-to-Market Program Under the Multifamily Assisted Housing Restructuring Act of 1997, recorded prior to the first mortgage, does not constitute a covenant, condition or restriction under which the lien of the first mortgage refereed to in Schedule A can be divested, subordinated, or extinguished, or its validity, priority, or enforceability impaired.
This endorsement is made a part of the policy and is subject to all of the terms and provisions thereof and of any prior endorsement thereto. Except to the extent expressly stated, it neither modifies any of the terms and provisions of the policy and any prior endorsement, nor does it extend the effective date of the policy and any prior endorsements, nor does it increase the face amount thereof.
