The Washington Supreme Court has upheld the authority of public utility districts to contract for a lien to secure payment of electricity charges. Hite v. PUD #2, 112 Wash. 2d 456, 772 P.2d 481 (1989).

There is no statute which expressly gives public utility districts the authority to contract for liens. Nevertheless, the court ruled that this authority was implied or incident to other powers expressly granted by statute to the districts.
